To prove someone committed the crime of assault the prosecution must prove that person did any act, which is intended to cause pain or injury to, or which is intended to result in physical contact, which will be insulting or offensive to another, coupled with the apparent ability to execute the act. Further, putting anyone in fear of assault with the apparent ability to execute the act can also be charged as an assault. Assaults can include pointing a gun at someone.
